Terms & Conditions

1. These terms and conditions and any conditions subsequently set by the Promoter (Continental Wine & Food Ltd) apply to The Straw Hat ‘Great British Giveaway’ promotion (the Promotion).

2. The competition is only open to residents of the United Kingdom, aged 18 and over. Purchase is necessary.

3. All entrants participating in the Promotion are bound by these terms and conditions.

The Promotional Period:

4. The main promotional entry period is from 00.00 BST 15th April 2019 and will close at 23.59.59 BST on 29th September 2019 (the Promotional Period).

5. All entries into the Promotion will also be entered into the Final Raffle at the end of the Promotional Period with the prize being the £3000 Virgin Gift Card (drawn on 14th October 2019).

To Enter:

1. Purchase a promotional bottle of The Straw Hat and go to www.thestrawhat.co.uk/giveaway.

2. Fill out the form with your full name, email address, contact number, full postal address.

3. Enter the 7 or 8 digit unique code found on the peel off back label on the promotional bottles, codes can only be used once.

4. Winners will be notified within 14 days via email.

Participating Products:

6. To participate in the Promotion, one of the following promotional bottles must be purchased:

- The Straw Hat Red 75cl

- The Straw Hat White 75cl

- The Straw Hat Rosé 75cl

7. Each code is unique and can only be entered once.

8. All entries must be received by the end of the promotion period to be valid and no liability is accepted for late entries.

9. The following persons are not eligible to enter the Promotion:

- Employees of any business involved or associated with the Promotion (including the Promoter and its associated companies, any appointed agency and any other agent or representative) any such person's family or household members.

10. The Promoter and/or any appointed agent reserves the right to verify the eligibility of all entrants.

11. Internet access is required to enter. Visit www.thestrawhat.co.uk/giveaway to input the unique code printed on the underneath of the back label on promotional bottles of The Straw Hat.

12. All fields on the online entry form must be completed to validate the entry. All entrants must register with a valid email address and enter their unique code. No responsibility can be accepted for entries incomplete, incorrectly completed or not received for whatever reason. Neither the Promoter nor any appointed agent will accept responsibility for any technical or other error that might arise whilst submitting any entry.

13. Promotional bottles will be available in selected stores while stocks last.

Winners Selection:

14. 650 winning moments, each day of the promotion period have been randomly and securely selected. Those valid entrants entering their unique code on or first after one of these winning moments will win a prize. If a winning moment is not claimed, it will roll over to the next valid entry so that the prize may still be won. This will be renewed each day & prizes will not be rolled over to the following day. If, for whatever reason, the prize is still not claimed it will go into the Final Raffle along with the top prize at the end of the Promotional Period.


15. Winners will be notified via email within 14 days of entering if they have won and what prize they have won.

16. All winners must retain their promotional label and till receipt, as this may be required to validate their prize. Excluding entrants in Northern Ireland, these will be dealt with on an individual basis.

17. In the event of failure from the winner to claim or receive their prize, after reasonable attempts by the Promoter to make contact (by telephone or email) within 28 days of first attempting to notify the winner, the Promoter reserves the right at its absolute discretion to withdraw prize entitlement or enter the prize into the Final Raffle at the end of the promotional period (14th October 2019) for all entrants into the competition.

18. Winners of the Final Raffle will be notified by email after 14th October 2019 and have 28 days to claim their prize.

19. Winners agree that the Promoter may use your name and county of residence to announce the winners of this promotion and the Promoter is also entitled to utilise their details and they will participate in any publicity arising in connection with this promotion. These details will only be stored until the end of the promotion, unless the entrant gives their consent, via the tick box on entry, for us to send them marketing material thereafter.

20. No cash or other alternative will be offered in whole or in part for any of the available prizes or gifts except, in the event of circumstances outside the reasonable control of the Promoter, the Promoter reserves the right to substitute a prize or gift of equal or greater value.

21. If the entrant has won, The Promoter will send an email to the email address provided informing the entrant what prize they have won. This will also include The Entrants details to confirm that these are correct. The Promoter will only send the prize once the second email has been confirmed. The Promoter will endeavour to despatch prizes to arrive within 28 days of the Winners confirmation of postal address/email address.

22. The Prizes are non-transferable, non-refundable and no cash alternatives will be given. The Prizes are subject to availability. The Promoter reserves the right at its absolute discretion to substitute a similar prize of equivalent or greater value or to amend the prize if necessary.

23. The Promoter will not be liable for any prizes which are lost, delayed, or damaged in the post for reasons beyond their control.

24. Where prizes are to be delivered to the personal address or sent to the email address of a winner, the prize will only be delivered to an address within the UK and will only be sent once. Should a prize-winner’s contact details change, it is their responsibility to notify us or the contact persons for the relevant promotion.

25. In the event of any dispute regarding the Promotion, the decision of the Promoter and/or any appointed agent is final and no correspondence or discussion shall be entered into. The Promoter and/or any appointed agent reserves the right to disqualify any entrant if it has reasonable grounds to believe the entrant has breached any of these terms and conditions. In the event that any entrant is disqualified from the Promotion, the Promoter in its sole discretion may decide whether a replacement should be selected.

26. The winner’s names and counties of residence can be obtained for a period of two months after the closing date by sending a stamped Self-Addressed Envelope marked The Straw Hat Great British Giveaway Competition to The Marketing Team, Continental Wine & Food Ltd, Trafalgar Mills, Leeds Road, Huddersfield, HD2 1YY. All entrants agree to this information being supplied and the new GDPR law does not affect this. All personal information will be destroyed thereafter, unless authorisation is given otherwise.

27. The Promoter’s decision will be final in all aspects of this promotion.


28. There are a total of 651 prizes available to be won. 650 prizes are assigned to 650 winning moments throughout the Promotional Period. The entrant must fill out the form with all their contact details and input their unique code in the designated area on the website.

29. The prizes that are available to be won are as follows:

- 300 x £20 Leisure Voucher gift cards

- 90 x £50 Amber Collection LastMinute.com Experience Day vouchers

30. If, for any reason, any prizes are left unclaimed at the end of each day, they will be added into the final prize draw of all the entrants and picked at random.

31. If the entrant wins a bottle of The Straw Hat, the Promoter will pick the variant at random & the winner cannot specify which they would like to receive.

32. All entrants will automatically have access to a 15% discount code, which can be used at https://experiences.lastminute.com.

33. By entering this Promotion, you hereby warrant that all information submitted by you is true, current and complete. Any information submitted by you must be personal to and relate specifically to you. You hereby warrant that the information which you submit and/or distribute will not infringe the intellectual property, privacy or any other rights of any third party, and will not contain anything which is libellous, defamatory, obscene, indecent, harassing or threatening.

34. Any personal data relating to entrants will be used solely in accordance with current UK data protection legislation, and will not be disclosed to a third party outside the Promoter and/or any appointed agent without the individual's prior consent unless entrants indicate otherwise via the relevant tick box at point of entry. Once the competition ends and all prizes have been allocated, all personal details will be deleted.

35. All entries must be made by the entrant themselves. Bulk entries made from trade, consumer groups or third parties will not be accepted. Incomplete or illegible entries, entries by macros or other automated mean (including systems which can be programmed to enter), and entries which do not satisfy the requirements of these terms and conditions in full will be disqualified and will not be counted. If it becomes apparent that an entrant is using a computer(s) to circumvent the condition by, for example, the use of ‘script’, ‘brute force’, masking their identity by manipulating IP addresses, using identities other than their own or any other automated means in order to increase that entrant’s entries into the Promotion in a way that is not consistent with the spirit of the Promotion, that entrant’s entries will be disqualified and any price awarded will be void.

36. If for any reason the Promotion is not capable of running as planned for reasons including but not limited to tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right (subject to any written directions given under applicable law) to disqualify any individual who tampers with the entry process and to terminate, modify or suspend the promotion.

37. If an act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these terms and conditions, the Promoter will not be liable for any failure to perform or delay in performing its obligation.

38. No responsibility is accepted for entries lost, damaged or delayed or as a result of any network, computer hardware or software failure of any kind. Proof of sending will not be accepted as proof of receipt.

39. The Promoter accepts no liability for any loss, injury or damage to any persons or property from participation in the Promotion or from any prize to the extent permitted by law.

40. If the entrant gives The Promoter authorisation to send them marketing material, the Promoter will only use the entrants data for marketing purposes. The entrant can opt out of this at any time by sending an email to unsubscribe@thestrawhat.co.uk. The Promoter will not supply any personal data to third parties.

41. Any entrant into the competition may at any stage withdraw from the competition and request that any personal data held by the Promoter is deleted and destroyed.

42. The Promoter and organiser is Continental Wine & Food Ltd, Trafalgar Mills, Leeds Road, HUDDERSFIELD, West Yorkshire, HD2 1YY, England. All communication regarding this Promotion should be forwarded in writing to The Marketing Team, Continental Wine & Food Ltd, Trafalgar Mills, Leeds Road, HUDDERSFIELD, West Yorkshire, HD2 1YY, England. 45. The winner must ensure they speak to an agent about using Virgin Gift Card before they book. You will not be able to redeem your Virgin Gift Card against a Virgin Holiday booked online or if the booking includes any other discount or offer.

Holiday & Travel Booking Instructions:

46. The Virgin Gift Card can be redeemed via the Virgin company that the winner wishes to purchase from directly on the telephone number provided.

47. Before booking please note the winner MUST call and speak to an operator on 0344 557 4321 and explain they want to use a Virgin Gift Card.

48. The winner will be unable to redeem a Virgin Gift Card for bookings made online.

49. Virgin Gift Card cannot be used in conjunction with any other vouchers, discounts or offers or incentive schemes (including Flying Club Air miles).

The lastminute.com experiences website is owned and operated by lastminute.com Ltd (a company registered in England under company number 2409444 and whose registered address is at lastminute.com Ltd , Stamford House, Boston Drive, Bourne End, Buckinghamshire, SL8 5YS) (referred to in the terms and conditions below as "lastminute.com”).


Face value vouchers issued by lastminute.com entitle the holder to choose, up to the value stated on them, one of a range of experiences supplied by lastminute.com. Experience vouchers do not have a value stated on them and entitle the holder to the experience stated on them. The actual fulfilment of the experience will be by selected third party experience operators acting on our behalf. All lastminute.com Vouchers (“Vouchers”) carry a unique serial number, which must be quoted when dealing with lastminute.com and its experience operators. Vouchers must be kept safely and securely and should be taken on the day of the experience and surrendered to the operator or alternatively sent to the operator if requested to secure the booking. We recommend sending them by secure mail as they are not replaceable if lost. We cannot accept responsibility for any loss you may incur as a result of theft, impersonation or identity fraud.


The placing of an order constitutes your acceptance of Virgin Experience Day’s Terms & Conditions of trading but does not constitute the creation of a contract. lastminute.com reserves the right to decline to process an order for any reason whatsoever. The contract is between you and lastminute.com, once we have processed your order and received payment. For the protection of our customers and to ensure that your credit, debit or charge card is not being used without your consent, we will validate name, address and other personal information supplied by you during the order process against appropriate third party databases. By accepting these terms and conditions you consent to such checks being made. In performing these checks personal information provided by you may be disclosed to a registered Credit Reference Agency which may keep a record of that information. You can rest assured that this is done only to confirm your identity, that a credit check is not performed and that your credit rating will be unaffected. All information provided by you will be treated securely and strictly in accordance with the Data Protection Act 1998. If an order cannot be fulfilled for any reason, lastminute.com will promptly refund all monies. Duplicate orders are sometimes inadvertently placed or despatched. International/overseas orders

All prices shown on lastminute.com websites are in GBP and all transactions are conducted in GBP. Experience descriptions, formats and durations

Experience descriptions, format and timings given on lastminute.com websites and in any other literature are only intended to present a general idea of the experience, and shall not be considered binding. In particular, photographs are for illustrative purposes only and do not form part of any contract between you and lastminute.com. As lastminute.com offers experiences at a wide number of venues, details such as session lengths, itineraries, equipment used and numbers of participants may vary from location to location. Most experiences will be “open” days meaning that other members of the public will be taking part too. This could mean taking your turn with other members of the public. If delays, curtailments and breakdowns are not within Virgin Experience Day’s control, we cannot be held liable if these should occur. Please note that we reserve the right to alter any part of the experience where such an alteration has been imposed by the operator. We cannot be held responsible for descriptions by or on any third party or agent sites. Experiences may occasionally be withdrawn for reasons outside of our control, and lastminute.com cannot be held liable for any costs incurred as a result of this. Should this occur, you or your recipient will be advised and offered the opportunity to exchange your voucher for one with the same face value. If alternatives are available, no refunds can be offered.


The recipient is free to book their preferred date within the Voucher validity period. Experiences are subject to availability and, in some cases, may be subject to weather conditions (if your experience is weather dependent we advise telephoning the centre before you set out to confirm that the event will take place). To avoid disappointment we recommend that customers book well in advance, at least 6-8 weeks for the majority of experiences. During peak periods it may be necessary to allow a longer notice period although some operators may occasionally be able to fit in a booking at short notice. We recommend booking as early as possible as you must have undertaken your experience before the expiry date printed on the front of your Voucher. We strongly advise that you do not make any travel, accommodation or other arrangements until you have received confirmation of your booking from the experience operator. Once a date has been booked with a supplier your Voucher will be deemed to be used at that point.


Most experiences are subject to restrictions. These could include (but are not limited to) age, height, weight, physical and medical restrictions, and may vary from centre to centre so please check before making your booking. Details of these restrictions are available on our website and by visiting www.lastminute.comexperiencedays.co.uk/myvoucher. It is your responsibility to ensure that you choose an experience appropriate for the intended recipient and it is the responsibility of the recipient to double check that the restrictions are not prohibitive. If you are unsure of the suitability please telephone us and we will be happy to advise you.


Spectators are usually welcome but occasionally a centre may make a small charge to cover insurance and/or refreshments. Some venues may have restrictions on spectators due to safety regulations. Participants are advised to check with the centre when booking.

Prices & locations

We reserve the right to vary the prices of the experiences which we offer. lastminute.com’s current experience prices may differ from the value of your face value voucher. Locations are correct at the time of going to press but may change or be withdrawn for reasons beyond our control. For overseas experiences prices may fluctuate with exchange rates.


Prices shown include V.A.T when and where applicable.


lastminute.com cannot be held responsible for any goods damaged in the post or any postal delays.


Vouchers are valuable documents and cannot be replaced if they are lost, damaged or stolen and are invalid if altered or tampered with. lastminute.com accept no liability in these circumstances.


The Voucher validity period is generally 9 months from date of purchase unless otherwise stated. Experiences must be booked and undertaken prior to the expiry date printed on the front of the Voucher, otherwise the Voucher will be deemed to be invalid and no liability will be accepted by lastminute.com.


All experience vouchers are valid for 9 months from date of purchase unless otherwise stated. If you can’t take your experience within the validity period, and provided your voucher has not expired, you may be able to extend it extended vouchers have an additional validity period of up to 9 months and there is an administration fee of £20. If the price of your chosen experience has increased you will be required to pay the difference between the new experience price and the value of your voucher. The administration fee along with the original voucher and any further payments must be sent to lastminute.com for an extension to be processed. Once a voucher has been extended it cannot be refunded. It may be possible to exchange - to find out further information please contact our Customer Service Team. Some vouchers can’t be extended. These include expired vouchers, promotional vouchers, multi–choice vouchers, activation cards and gift cards.


Experience vouchers are flexible. If you want to exchange your voucher this is what you need to know: You can exchange for most experiences and products on our website unless they are on our excluded products list. If your exchange is more expensive than your original voucher you will be required to pay the difference. If your exchange is less expensive than your original voucher the difference will be held as a credit to use against any future purchase up until the original expiry date of your voucher and is non refundable. Your first exchange is free of charge, any subsequent exchanges will have an administration charge of £20. The exchanged voucher will carry the same expiry date as the original purchased voucher. You can merge vouchers provided they have not been merged before and they have been purchased from the same retailer brand or website. There is an administration fee of £20 for merging vouchers and the new voucher will carry the expiry date or the earliest merge voucher. To exchange your voucher please call our Customer Service Team and they will be happy to advise you of our process.


Refunds can be made on unused vouchers bought direct from lastminute.com within 14 days of purchase. A refund cannot be given once the booking has been made with the experience provider. Refunds can only be made to the purchaser and the monies will be refunded directly to the original method of payment. Refunds cannot be given on expired, extended or exchanged vouchers. The following tangible gifts cannot be refunded: personalised items, perishable goods or earrings (for hygiene reasons). A voucher purchased through a retailer or other reseller will be subject to that retailer’s own refund policy and enquiries must be made directly to them. We cannot refund items purchased from a retailer or other resellers. Competition prizes or promotional free gifts cannot be refunded. To request a refund please send your voucher along with a covering letter explaining the reason for your request to lastminute.com Ltd .


The cost of returning your Voucher for exchange or refund will not be borne by lastminute.com and we strongly recommend that a secure delivery service such as Royal Mail Special Delivery (with postal insurance as appropriate) is used as Vouchers cannot be exchanged or refunded until they are received by us.

Experience operators

lastminute.com has contracted agreements with its operators regarding their standard of performance and, where appropriate, operators are registered with their relevant controlling or regulatory bodies. Once a booking has been made with an experience operator the participant is also bound by the Terms and Conditions of that operator. By purchasing or redeeming an lastminute.com Voucher you acknowledge that experiences are dependent on certain factors beyond the control of lastminute.com and agree that lastminute.com is not liable for the cancellation, postponement or alteration of any experience for reasons beyond its reasonable control (including but not limited to weather-related reasons, mechanical failure, location changes or otherwise). If mechanical breakdown should occur you should expect reasonable substitutions without notice. Please note that experiences and other products are subject to change without notice. This does not affect your statutory rights.

Problems on the day

We welcome your feedback on all of our experiences. If you encounter a problem on the day, please immediately bring it to the attention of the host or experience operator at the venue so that they have a chance to put matters right. If you have attempted resolution but the problem was not resolved on the day, please write to us within a week of your experience (providing your Voucher serial number, participant’s name and venue details, including who you spoke to on the day) and we will be happy to take the matter up with the operator on your behalf. Please note that the operator will have the opportunity to investigate and respond.

Cancellation by experience operators

If an experience is cancelled by the operator either before or on the day of the event due to circumstances beyond their control, the operator will arrange to re-book the participant at a mutually agreed time on our behalf. lastminute.com cannot be held liable for any costs including (but not limited to) travel expenses or pre-booked accommodation costs incurred by the participant in the event of a cancellation and lastminute.com’s total liability for any claim in connection with an lastminute.com experience shall be limited to the price paid for the experience.

Cancellation by participants

Once you make a booking with an experience operator you are bound by their terms and conditions. Make sure you understand their rules regarding changing or cancelling a booking (particularly at short notice) as a refund will not be offered in the case of infringement of these rules. Virgin Experience Day’s Cancellation Indemnity policy may provide a replacement Voucher in the event of cancellation by the participant owing to circumstances beyond their control.

Liability cover

All UK and Eire experience operators contract with us to indemnify participating Voucher holders against damage to equipment they use, and against liabilities to third parties, subject to limits and compliance with their rules, terms and conditions, which may vary between operators. We also hold cover, subject to terms and limits, for contingent liabilities arising at these operators’ venues. Where experiences require overseas travel, the participant is strongly advised to take out additional specialist travel insurance. Some experience operators may offer additional indemnities at an extra cost. Such indemnities are entirely optional and you are under no obligation to purchase them, as your entitlement to undertake the experience will not be affected if you choose not to accept an additional indemnity. Any additional indemnities purchased from an experience operator will be governed by that operator’s terms and conditions and do not form any part of your contract with lastminute.com.

Competition prizes, special offers and promotional offers

These may have restrictions including (but not limited to) dates and times of use, validity periods and experience range or content so please be sure to check these before purchasing and telephone our Experience Helpline if you are in any doubt. Competition Prizes, Special Offers and Promotional Offers cannot be refunded or extended unless otherwise specified. (A promotional product refers to a voucher which was sold at a discounted price or as part of a special offer, whether or not this is stated on the voucher).

Discount codes & entitlements

lastminute.com reserves the right to exclude any product or experience from discount schemes. Only one discount code may be used per order. Discounts apply to new orders only and cannot be used against exchanges, extensions, money on account, delivery and fulfilment charges or any other facility provided by lastminute.com. You may be required to provide evidence of your entitlement to any discount.

Third parties and re-sale

A person who is not named on the face of the Voucher or recorded as the purchaser by lastminute.com has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any terms and conditions of booking. A Voucher which has been re-sold (for example, through internet auction sites or by any other means) without our prior consent will be considered invalid. Neither lastminute.com nor any of its experience operators will be under any obligation to provide any service. Please note that we have the ability to retain any data that you provide on this website using VeCapture by Ve Interactive, even if you do not complete your registration/transaction by clicking submit/next. Such contact details and data may be used to contact you to enquire why you did not complete your registration/transaction and improve our online operations.

These terms and conditions do not affect your statutory rights as a consumer, and are governed by and in accordance with English law. The purchaser of a Voucher and/or the participant in an experience agrees to the jurisdiction of the English courts. All the clauses and sub clauses in Virgin Experience Day’s terms and conditions are independent of each other. If one clause or sub clause is invalid or unenforceable, this will not affect any other clause or sub clause. These terms & conditions are subject to change.

The details listed above are the terms and conditions applied to lastminute.com Vouchers and experiences. Your statutory rights are not affected.

Leisure Voucher Gift Card Terms and Conditions

Leisure Voucher are no way affiliated with Continental Wine & Food Ltd or The Straw Hat British Wine.

These Terms and Conditions apply to the Leisure Voucher Gift Card. You must read them carefully. They form the contract between you and us governing use of the Gift Card. In these Terms and Conditions:

"Cardholder" means the person who purchased the Gift Card and all subsequent Gift Card holders whether registered or not.

"Denominated Currency" means pounds sterling.

"Distributor" means Acorne Ltd who distribute the Gift Card to you on behalf of Contis Financial Services Ltd.

"Gift Card" means the Leisure Voucher Gift Card issued by Contis Financial Services Limited, Navigation House, Belmont Wharf, Skipton, North Yorkshire, BD23 1RL. The Gift Card is not covered by the Payment Services Regulations 2009 or the Electronic Money Regulations 2011.

"You" and "your" refer to the Cardholder. "We", "us" or "our" means Contis Financial Services Ltd. "Website" means the website at www.leisurevouchers.co.uk.

You are liable for each transaction undertaken on your Gift Card until such time that your Gift Card is cancelled in accordance with section 7 below.

1. Leisure Voucher Gift Card

The Gift Card is a prepaid payment card which may be used for purchasing goods and services at participating retailers. A full list of retailers can be found at the Website. You cannot use the Gift Card at retailers who do not participate in the Leisure Voucher Gift Card programme. You may use the Gift Card for mail order, telephone or internet purchases at participating retailers, details of which can be found at the Website. You cannot withdraw cash from an ATM. You should not attempt to use the Gift Card at non-participating retailers.

The Gift Card is valid for a period of 12 months from the date of purchase. If your Gift Card is reloaded you will always be given a minimum of 12 months to spend these funds which may extend the validity of the Gift Card past the initial 12 month period.

Your Gift Card is not a credit card and is not in any way connected to your bank account. Funds held by us on your behalf are not deposits and you will not earn any interest on any funds loaded on your Gift Card.

2. Purchasing, Loading and Activating Your Prepaid Card

Gift Cards many be purchased via the Website or you may be issued with a Gift Card through a third party organisation. The Gift Card will be loaded with funds on purchase. Gift Cards can be loaded by contacting customer services. Fees and limits may apply to loads and reloads.

We may require evidence of your identity and your residential address. We may ask you to provide some documentary evidence to prove this and we may carry out checks on you electronically.

3. Registering your Gift Card

We recommend that you register your Gift Card as soon as you receive it. You can do this by entering your details at the Website. Once you have registered your Gift Card you can use it to make purchases online at participating retailers, reload funds onto the Gift Card or report it lost or stolen. If you do not report your card lost or stolen, you may lose your money on your Gift Card, in the same way as if you lost cash in your wallet or purse. If you do not register your Gift Card we cannot provide you with these additional services.

4. Using your Gift Card

Your Gift Card can be used for purchasing goods and services at participating retailers, however, like any payment card we cannot guarantee that a retailer will accept the Gift Card.

A Gift Card transaction will be regarded as authorised by you where you have sufficient balance for the purchase and you follow the instructions provided by the retailer after swiping the magnetic stripe on the Gift Card or by entering the Gift Card details at the retailer's online store if you have registered the Gift Card. Authorisation for a transaction may not be withdrawn (or revoked) by you once we have received it.

Your Gift Card may be used in full or part payment for purchases. In the case of part payments you will be required to pay for the outstanding amount of the purchase by an alternative method such as cash, debit or credit card. You should notify the retailer that you wish to make a part payment and of the remaining balance on your Gift Card before proceeding with the purchase. Not all retailers support part payments and you should check with the retailer before attempting a part payment.

We will deduct the value of your transactions from the balance on your Gift Card as soon we receive notification of the transaction from the payment scheme network. We will also deduct any applicable fees as soon as they become payable by you.

Your Gift Card is denominated in the Denominated Currency and you can only make transactions in the Denominated Currency.

We recommend that you check the balance and any recent transactions on your Gift Card regularly through the Website or by contacting Customer Services.

Any returns and exchanges for goods purchased will be governed by the policy of the retailer and applicable law. The retailer may not apply a credit to your Gift Card and instead must issue its own note of credit for a refunded item.

If you dispute a transaction that has been processed on your Gift Card you should contact the retailer to resolve the dispute.

We may at anytime suspend, restrict or cancel your Gift Card or refuse to issue or replace a Gift Card if we suspect your Gift Card is being used in an unauthorised or fraudulent manner, if you have not complied with these terms and conditions or in the event of exceptional circumstances which prohibit the normal operation of the Gift Cards.

5. Cancellation and Refund Process

The purchaser of a Gift Card via the Website is entitled to a 14 day 'Cooling-Off Period'. The Gift Card should be returned to Customer Services unused with your original sales receipt and a full refund will be made (less the postage fee) to the card used to purchase the Gift Card.

6. Keeping Your Gift Card Secure

You should treat your Gift Card like cash. If it is lost or stolen, you may lose some or all of your money on your Gift Card, in the same way as if you lost cash in your wallet or purse. As a result, you must keep your Gift Card safe and not let anyone else use it. Security information includes your memorable data set up on registration of your Gift Card.

We recommend that you check the balance on your Gift Card regularly through the Website or by calling Customer Services.

7. Lost, Stolen or Unauthorised Payment

If you have registered your Gift Card and you lose it or it is stolen you must tell us as soon as possible by calling the Lost and Stolen Card Line. Once we have verified that you are the registered Cardholder we will immediately cancel your Gift Card and will not authorise any further transactions. If, after reporting a lost card, you subsequently find the card you must not use it. Cut it in half through the magnetic strip.

You may request a Replacement Gift Card for which a fee will apply. Any outstanding balance less the Replacement Gift Card Fee will be transferred to the Replacement Gift Card. Requests to replace a Gift Card may be denied at our discretion if we suspect fraudulent or other unlawful activity.

8. Your Liability

In the event that you do not use your Gift Card in accordance with these Terms and Conditions or we find that you are using the Gift Card fraudulently, we reserve the right to charge you for any reasonable costs that we incur in taking action to stop you using this Gift Card and to recover any monies owed as a result of your activities.

In the unlikely event, for any reason whatsoever, a transaction is completed when there are insufficient funds on the Gift Card for that transaction (a "Shortfall"), the Shortfall shall be reimbursed by you unless it is due to an error on the part of the retailer where the Gift Card was presented, in this circumstance we may seek the Shortfall from the retailer. We reserve the right to charge you an Administration Fee for each transaction that you make using your Gift Card that results in a Shortfall or increases the Shortfall amount on your Gift Card.

You are liable for each transaction undertaken on your Gift Card until such time that your Gift Card is cancelled in accordance with section 7 above.

9. Our Liability

Like other payment cards, we cannot guarantee a retailer will accept your Gift Card, or that we will necessarily authorise any particular transaction. This may be because of a systems problem, something outside our reasonable control, to comply with legal and regulatory requirements, or because we have suspended, restricted or cancelled your Gift Card or refused to replace it in accordance with these Terms and Conditions. We shall not be liable in any event that a retailer refuses to accept your Gift Card, or if we do not authorise a transaction, or if we cancel or suspend use of your Gift Card.

From time to time, your ability to use your Gift Card may be interrupted, e.g. when we carry out maintenance. If this happens, you may be unable (a) to use your Gift Card to pay for purchases and/or (b) to obtain information about the funds available on your Gift Card and/or about your recent transactions. We will not be liable for any loss arising from such interruptions.

Unless otherwise required by law, neither we nor the Distributor shall be liable for any direct or indirect loss or damage you may suffer including loss of revenue, goodwill, opportunity or anticipated savings as a result of your total or partial use or inability to use your Gift Card, or the use of your Gift Card by any third party (including any fraudulent use by any third party).

We are not responsible for the quality, safety, legality or any other aspect of any goods or services purchased with your Gift Card. Remember that once you have used your Gift Card to make a purchase we cannot stop that transaction.

10. Changes to These Terms and Conditions

We may change these Terms and Conditions at any time. The most recent version of the Gift Card Terms and Conditions will always be available on the Website. You should check the site regularly for the up to date Terms and Conditions. Unless you tell us that you do not agree to the change prior to the change being effective we will assume you accept such change.

11. Data Protection

We will process and retain personal data in order to open, administer and run your Gift Card account. We will transfer your personal data within our groups of companies, to the Distributor and to other third parties in order to issue and run your Gift Card. We my transfer your personal data outside the EEA, when we do this we will take steps to ensure that your data is afforded the same level of protection as it would if your data was processed within the EEA.

If you are unhappy in any way with your Gift Card or the way it is managed, you can contact Customer Services so we can investigate the circumstances for you. Any complaints you have will be dealt with quickly and fairly

13. Governing Law

This Agreement is concluded in English. All communications with you will be in English. These Terms and Conditions will be subject to English law and to the exclusive jurisdiction of the English courts.
